Getting there took six years, a reversal, and an act of the legislature.<\/span><\/p><p><span data-contrast=\"auto\">In January 2019, the Department <\/span><a href=\"https:\/\/www.dechert.com\/knowledge\/onpoint\/2019\/2\/pennsylvania-regulator-deems-virtual-currency-trading-platforms-.html\"><span data-contrast=\"none\">concluded<\/span><\/a><span data-contrast=\"auto\"> that virtual currency was not \u201cmoney\u201d under the Act and that exchanges and kiosk operators needed no license. In April 2024, it published a <\/span><a href=\"https:\/\/www.pacodeandbulletin.gov\/Display\/pabull?file=\/secure\/pabulletin\/data\/vol54\/54-16\/542.html\"><span data-contrast=\"none\">statement of policy<\/span><\/a><span data-contrast=\"auto\"> reversing that reading, effective October 15, 2024. The legislature then settled the question in statute.<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p><p><a href=\"https:\/\/legiscan.com\/PA\/bill\/SB202\/2025\"><span data-contrast=\"none\">Senate Bill 202<\/span><\/a><span data-contrast=\"auto\">, signed by Governor Josh Shapiro on June 27, 2025, became Act 7 and took effect 60 days later. It requires any person who transmits virtual currency for a fee to hold a Department license, modernizes the Act\u2019s definitions and exemptions, and makes Pennsylvania one of roughly 27 states regulating virtual currency in this way. The 2024 policy statement was <\/span><a href=\"https:\/\/www.pacodeandbulletin.gov\/Display\/pabull?file=\/secure\/pabulletin\/data\/vol55\/55-32\/1057.html\"><span data-contrast=\"none\">rescinded<\/span><\/a><span data-contrast=\"auto\"> the same day.<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p><p><span data-contrast=\"auto\">Department Secretary Wendy Spicher was direct in <\/span><a href=\"https:\/\/www.pa.gov\/agencies\/dobs\/newsroom\/dobs-regulating-virtual-currency-transmitters-thanks-to-new-bipa\"><span data-contrast=\"none\">announcing<\/span><\/a><span data-contrast=\"auto\"> it: before Act 7, a company transmitting money for a fee needed a license, but one transmitting Bitcoin did not, and \u201cthat gap left consumers unprotected.\u201d Applications are filed through the <\/span><a href=\"https:\/\/www.csbs.org\/nationwide-multistate-licensing-system-nmls\"><span data-contrast=\"none\">Nationwide Multistate Licensing System<\/span><\/a><span data-contrast=\"auto\"> (NMLS), and unlicensed operators serving Pennsylvania residents have been in breach since August 2025.<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p><h2 aria-level=\"2\">What gap did Act 7 leave open for crypto kiosks?\u00a0<\/h2><p><span data-contrast=\"auto\">Act 7 regulates transmission. It creates no kiosk-specific regime, and the kiosk is where the documented harm concentrates.
